La Guardia Civil detiene a cinco personas acusadas de un delito contra la propiedad industrial por falsificar prendas valoradas en más de tres millones de euros.

La mayor parte de los detenidos son de origen chino, quienes a través de cuatro empresas, importaban bolsos, carteras y prendas de vestir falsificadas.

La operación contó con el apoyo de un perito adscrito a la Comisión Antipiratería del Ministerio de Cultura.

La Unidad Orgánica de Policía Judicial de la Guardia Civil de S/C Tenerife (Equipo de delitos contra el Patrimonio de  la Comandancia de la Guardia Civil de S/C de Tenerife), ha venido desarrollando desde el mes de noviembre del pasado año una operación denominada Copyright, dedicada a la investigación de un delito contra la propiedad Industrial, tras la detención de una persona en la isla de La Palma, acusada de vender prendas falsificadas de conocidas marcas registradas.

Tras la citada actuación realizada por la patrulla del Puesto Principal  de la Guardia Civil de Santa Cruz de La Palma, donde se intervinieron prendas falsificadas por casi 9.000 euros, y la información aportada sobre la posible procedencia de los efectos, la Unidad Orgánica de Policía Judicial inició una investigación con el fin de localizar los comercios mayoristas que abastecían a los vendedores ambulantes y mercadillos  de las islas de productos falsificados de marcas comerciales registradas.

Las investigaciones realizadas permitieron detectar a cuatro empresas, tres ubicadas en Santa Cruz de Tenerife y una en Arona, que vendían carteras, bolsos y prendas de vestir que eran falsificaciones de marcas registradas.

Una vez dada cuenta de la investigación a la Autoridad Judicial, se procedió al registro de estas cuatro empresas, procediendo a la intervención de:

531 prendas de vestir. 1.926 carteras

2.335 cinturones

1.051 bolsos

1.025 logos.

En el marco de la investigación se pudo detectar el método para la introducción de efectos y su posterior preparación y venta con logos falsificados de conocidas marcas. Así, importaban desde China importantes cantidades de las prendas ya citadas, las cuales carecían de marca o referencia alguna, y compraban por otra vía los anagramas o logos de las marcas a las que pretendían simular, para realizar el ensamblaje y unión del logo y prenda ya en Tenerife, y proceder a su venta.

Todas las falsificaciones son de diferentes marcas comerciales de reconocido prestigio.

Para la identificación de los productos falsificados, así como de una primera valoración, se contó con el apoyo de un perito adscrito a la Comisión Antipiratería del Ministerio de Cultura, siendo fundamental el

referido apoyo por tener un conocimiento más extenso de todas la marcas comerciales, los puntos para la detección de las falsificaciones respecto a los productos originales, así como su valor comercial y el impacto económico de los efectos falsificados en el mercado lícito, siendo estimado el mismo en unos tres millones de euros

Los agentes procedieron a la detención de cinco personas relacionadas con los hechos, como presuntos autores de un delito contra la propiedad industrial.

Los detenidos y las diligencias instruidas fueron entregados en el Juzgado de Instrucción de Guardia de los de Santa Cruz de Tenerife.
